nutrients.
Staff Findings: The Staff provides the following findings of fact addressing the issue of
the non-conforming use for consideration:
1. All proposed business activities are proposed to be inside buildings.
2. The use of the property as a residence will remain the primary use. The area
devoted to business operations will be incidental to the structure.
3. The operation will be entirely within the structure. Retail sales on site will be
limited to appointments only.
4. There will be no employees on site other than the owner or those residing in the
home.
5. Most sales will be done off-site or by mail. On-site retail sales will be by
appointment only.
6. There will be no items for sale that will be visible from the street. There will be no
visible evidence of a home occupation except for the sign requested by the
applicant.
7. There is no reason to believe there will be any nuisance problems of noise,
vibration, smoke, dust, fumes or litter from this proposed use.
8. Customers will only visit the home by appointment and then, only in limited
numbers. There is adequate parking on the property already for this modest level
of traffic.
g. The only equipment used will be limited in scale and scope and compatible with
normal household operations.
Planning Commission Direction: The Planning Commission can approve of the
conditional use permit, deny the application, or table the request if additional
information is needed. If the motion is for approval or denial, findings of fact should be
cited.
Staff Recommendation: The Staff recommends that the Home Occupation be
approved as it is consistent with the requirements of the Code. We recommend that the
applicant be allowed on sign, a maximum of six square feet, as allowed by the Ordinance.
We further recommend that business-exclusive traffic be limited to a maximum of two
cars on site at any one time.
Pequot Lakes Staff Report 4(b)-4
April 15,2010
