CQMMUNITYGRowm City°f
1 N S T I T U T E
I'equot _
Experts in Sinaill Tbivit Planning
The applicant is now represented by Tom Fitzpatrick, a local attorney who specializes in
`.• land use law and is familiar with our codes. We will allow Mr. Fitzpatrick to make his
own presentation, but would preface his remarks by asking the Planning Commission to
be open to consideration of his analysis. This is a new application and, if we are to follow
due process,we must give open-minded consideration to the facts.
Mr. Fitzpatrick will likely point out that the narrow width of the lot combined with the
multiple non-conformities in the neighborhood make strict interpretation of the Code
impractical in this instance. He may also refer to a recent Minnesota Supreme Court case
where an order by Otter Tail County to remove a dwelling inadvertently constructed in
the setback was overturned. These are new facts the Board is allowed to consider.
If the Board of Adjustment should opt to approve the variance,we would recommend the
issues of screening and stormwater management be given consideration.
Pequot Lakes Staff Report 4(d)-3
March 18,2010
