Brian Laudenbach <br /> March 8,2010 <br /> Page 2 <br /> private facilities and signs are not allowed on R/W, and some encroachments can be a serious <br /> safety hazard close to a highway(like a propane tank or fuel vent pipes possibly being hit by a <br /> run-off-the-road vehicle?). Mn/DOT has a responsibility to clean up and protect our highway <br /> corridors one issue at a time as we find problems. This decision has been reviewed in-depth <br /> with and agreed on by district management. <br /> In addition to our removal requirements, Mn/DOT requests that the city require all removals of <br /> TH 371 R/W encroachments to be noted as a condition of any Conditional Use or other local <br /> permit approvals for this redevelopment. <br /> When the snow is gone I can schedule Surveys again to pin down exactly the R/W line along <br /> your entire parcel and we can finalize removal details as needed. Your work can wait till warm <br /> weather and thawed ground, but they must get done by July 1, 2010. Items 1 and 3 are easily; <br /> resolved. Item 2 will take some research by you into how these vent pipes are tied into buried <br /> piping that appears to be on the R/W,but for safety reasons and probable future public utility <br /> need of this R/W any buried fuel pipes must also be removed and the vent pipes relocated. <br /> Items 4 and 5 will need review after the snow's gone to determine the exact amount of pavement <br /> encroachments,and then we'll most likely require that the pavements be cut off at the R/W line <br /> and the R/W restored with topsoil and seed. Item 6 will require that the landscaping on R/W <br /> around the sign base be removed, and the main sign face frame up high that is protruding over <br /> �- the R/W line must be cut back/modified to be completely off R/W. From conversations with the <br /> city we are aware that Mn/DOT's requirements to get this sign off R/W may require the city to <br /> address the sign's possible nonconformance with current city standards, the city will decide their <br /> own course of action. However, it would be irresponsible on our part to ignore our obligations <br /> under state statutes regardless of how our enforcement may affect other jurisdiction's decisions <br /> for local compliance. <br /> Also,now that these issues have been noted,the R/W encroachments must still be removed <br /> whether or not this development proceeds. <br /> Thank you in advance for agreeing to cooperate and work with us to correct these issues.
