ii. The fagade signs are only being proposed on the east side of the building facing
- Highway 371.
12. The east side of the building was the only area used to calculate total fagade area.
13. The applicant is requesting a CUP for a reader board and additional free standing
signage that is specifically not allowed in Section 17-7.1(4)(C). The applicant has
submitted a sign concept plan.
14. The request for the additional sign is to allow a two additional free standing
signs, one to be used as a menu for drive-thru customers and the other as a
directional sign.
15. There have not been any alternatives to the sign request submitted.
16. The subject property is in the Downtown Mixed Use District.
17. Two free standing signs are allowed within the DMU District. A third free
standing sign and a flashing or revolving sign are not allowed.
18. The Comprehensive Plan does not specifically address this request but allows for
the use of commercial development within the City.
19. The use of the sign, with conditions, would be compatible with the existing
neighborhood in that there are other similar signs, albeit without the reader
board,within the same district.
20.The proposed use will not impair values nor substantially diminish properties in
the immediate vicinity.
21. The proposed use, with conditions, will not impede the normal and orderly
development and improvement of surrounding vacant properties.
22. The proposed sign will not create a cost for additional public facilities or services.
23. The lot is already established with vehicular approaches to the property. The sign
with reader board will be facing one of the approaches.
24. There is no need for additional parking with the request of a sign.
25. The requested sign will not create any odor, fumes, dust, noise or vibration. The
signs will be internally lit, however it is unknown whether or not they will be
turned off after business hours.
26.There are no indications that the proposed use will cause any pollution to ground
or surface waters.
Planning Commission Direction: The Planning Commission can approve of the
conditional use permit, deny the application, or table the request if additional
information is needed. If the motion is for approval or denial, findings of fact should be
cited.
Staff Recommendation: The approval of a Sign Concept Plan is at the discretion of
the Planning Commission. There are two items that Staff would suggest.
1. The freestanding sign where the proposed digital board is to be placed is non-
conforming. It exceeds the height and area for such a sign. It also encroaches
within Mn/DOT's right-of-way. It needs to be relocated or significantly altered to
conform to Mn/DOT's requirements. This is the only time the City would have a
reasonable expectation to see this sign brought into conformity. We recommend
that be done here as part of allowing signage in excess of what is permitted in the
Code.
2. If the Planning Commission is prepared to accept a digital sign, we recommend
that the Ordinance first be clarified to allow such signs — in whatever capacity the
Planning Commission feels is consistent with the character of the community —
Pequot Lakes Staff Report 4(b)-5
March 18,2010
