ARTICLE 28 <br /> DIRT MOVING/ WETLAND IMPACTS <br /> The standards in this Article shall apply to dirt moving activity within the Shoreland Zone and€riling, <br /> draining and ding wetland in all zoning districts where such uses activities are allowed. <br /> 28.1 POLICY <br /> It is the view of the Crow Wing County Board of Commissioners that protection of wetlands, <br /> protected waters and sensitive slopes and bluff areas is essential to the welfare of the County. <br /> The Board of Commissioners herein adopts the Wetland Conservation Act of 1991;pursuant to <br /> Minnesota State Statutes,Chapters 103A, 103B, 103E, 103F, 103G,-102G.345;The State <br /> Minnesota Rules <br /> Cens do A e4 Rules, Chapter 8420 including,but not limited toithe delegation of authority to <br /> local units of government for the protection of wetlands and water resources of the State of <br /> Minnesota. The application of the above may be limited within the provisions of this ordinance. <br /> In as much as the excavation or fill of materials into these protected natural resources is <br /> detrimental to the welfare of the State, Crow Wing County adopts a dirt moving permit review <br /> process that recognizes the need for protection while attempting to streamline the process. In <br /> addifien,the Cr-ew Wing Ceanty Watef Plan has pr-iefkized wetlands in sher-elands for-pFe4eeti <br /> due-tetheir-intfinsie fime4ions. To this end-achieve the aforementioned purposes,the following <br /> standards are adopted. <br /> 28.2 APPLICABILITY AND PERMITS <br /> Crow Wing County through the Plaftning and Zening Offiee Land Service Department is the <br /> Wetland Conservation Act Local Government Unit in and is responsible for <br /> notification and permitting requirements therein. The c^:, and Water-Cense.ye6e..Dist iet shat <br /> Crow Wing County adopts and administers the standards in this section which shall apply to all <br /> dirt moving, activities within shorelands and <br /> wetland impact activities in the unincorporated area of Crow Wing County. For the purpose of <br /> this ordinance, a wetland impact activity shall be defined as set forth in Minnesota Rules Chapter <br /> 8420.0111 subpart 32. A dirt moving activity ctivity shall be defined as any movement, excavation, <br /> grading or filling of f dirt. X411 Dirt moving or wetland impact activities in <br /> this Article may require a permit from the Land Services <br /> Department, ° °• °•_ �-�a�^� „° �+ +''° e�x'rr, and may require notification, review, <br /> gp rp oval and permit from the Minnesota Department of Natural Resources, tThe Army Corps of <br /> Engineers, tThe Board of Seil and Wa Water and Soil Resources and the Thirty Lakes <br /> Watershed District.
