8. There is an abundance of on-site parking spaces on the subject property. No <br /> off-street parking spaces will be required. <br /> 9. The applicant indicated that the northern building (proposed animal shelter) is <br /> insulated so that no animals will be able to be heard outside. The southern <br /> building should not produce any atypical noise. Adequate measures have been <br /> taken or will be taken to prevent or control offensive odor, fumes, dust, noise, and <br /> vibration, so none of these will constitute a nuisance and to control lights and <br /> signs in such a manner,that no disturbance to neighboring properties will result. <br /> 1o. There are not any known historical features of major significance on the subject <br /> property. <br /> ii. The subject property currently has three stormwater retention ponds and a <br /> private sewer system for which there are no proposed changes. The conditional <br /> use will promote the prevention and control of pollution of the ground and <br /> surface waters including sedimentation and control of nutrients. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> conditional use permit, deny the application, or table the request if additional <br /> information is needed. If the motion is for approval or denial, findings of fact should be <br /> cited. <br /> Staff Recommendation: This property has been a complex one for the City over the <br /> years, with a potpourris of uses approved for prior owners, none of them panning out <br /> quite as envisioned.The property has sat vacant for some time. <br /> None of the proposed uses in this application will have the potential for the level of <br /> impact envisioned with the Crafter's Mall, although the mall was an intermittent use and <br /> the uses proposed here,particularly the animal rescue facility,will be less transient. <br /> Additionally, none of the proposed uses will be so permanent in nature, or so <br /> dramatically impact the permanence of the site, as to change the economics of the <br /> realignment of TH 371. <br /> For these reasons, we recommend that the application be approved. We recommend <br /> consideration of the following conditions: <br /> 1. The uses shall be limited to those presented in the application. <br /> 2. The applicant shall prepare the data requested by the Crow Wing County <br /> Highway Department and shall fulfill all subsequent requirements of that <br /> department. <br /> 3. Proper licensing shall be obtained from Minnesota Board of Animal Health. <br /> In addition, while not recommending any of the following for this application, the <br /> conditions for the recently approved dog kennel are as follows: <br /> 1. Not more than 25 dogs shall be allowed on the property at any given time. <br /> 2. All dogs shall remain within the indoor kennels from the hours of 10 P.M. <br /> until 6 A.M. <br /> 3. A person responsible for the operation of the facility shall be on site whenever <br /> the dogs are allowed outside of the indoor kennel. <br /> 4. The grooming operation shall be allowed, but only as an accessory use to the <br /> boarding facility.
