The MPCA has sufFicient infaiYnation io allege that the <br />Regulated Party has violated the following provisions of federal regulations, state statutes, rules, <br />or permit conditions: <br />l. Minn. Stat. 116.081, PROHIBITIONS; Minn. R. 7001.3050, PERMIT <br />REQUIREMElYTS. <br />A solid waste management facility permit or permit modification is required to: <br />treat, store, process, or dispose of solid waste. <br />2. Minn, R. 7035.080Q, COLLECTI�N AND TRANSPC?RTATION OF SOLID WAST�. <br />Subp. 1. Owner's or occupant's duty. The owner and occupant of any premises, business <br />establishment, or industiy and/or the refuse collection service are responsible for the <br />satisfactory collection and transportation of all solid waste accumulated at a premise, <br />business establishment, or industry to' a solid waste disposal facitity for which a�erniit <br />has been issued by the agency, unless otherwise provided in these parts. <br />On September 11, 2007, the MPCA was notified of a cainplaint received by Pequot Lakes in <br />April 2007. The complaint stated that debris had been disposed of on the above listed property. <br />Upon iuspection by MPCA staff on 5eptember 1 l, 2007, it was found that there was debris <br />disposed of illegally. , <br />To address the allaged violations cited in this LOW, the Regulated Party is to complete the <br />following actions: <br />1.
