The applicant did not take action with 6
months of the approval and is now requesting an extension of the variance.
Typically, if the property owner does not act within 6 months of a variance approval and
it is not extended by the Board of Adjustment (it was not in this case), the variance is
void.
Applicable Regulations:
Section 17-11.7 VARIANCES
8. Failure by the owner to act within 6 months on a Variance unless
extended by the Board of Adjustment shall void the Variance. A second
extension shall require a new public hearing. This provision shall apply to
any Variance outstanding at the time of the Ordinance adoption.
Pequot Lakes Staff Report 7(a)-1
August 18,2011
