1 <br /> ORDINANCE NO. 15-01, SECOND SERIES <br /> AN ORDINANCE AMENDING CHAPTERS 3 <br /> AND 5 OF THE CITY CODE <br /> RELATING TO EMPLOYEE AND VOLUNTEER BACKGROUND AND <br /> CRIMINAL HISTORY INVESTIGATIONS <br /> CITY OF PEQUOT LAKES <br /> COUNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent. The purpose and intent of this ordinance amendment is to amend <br /> Chapter 3 of the Pequot Lakes City Code relating to employee and/or volunteer <br /> background investigations and Chapter 5 of the Pequot Lakes City Code relating to <br /> criminal history investigations. <br /> Amendment. Chapter 3, Article 3, Section 3-3.3 —Employee and/or volunteer <br /> background investigations, shall be repealed as follows: <br /> Section 3-3.3. EMPLOYEE AND/OR VOLUNTEER BACKGROUND <br /> INVESTIGATIONS <br /> The Pequot Lakes Police Department is authorized to conduct a criminal history <br /> background investigation on applicants for positions with the City. This applies only to <br /> applicants who are finalists for paid or volunteer positions with the City, where the <br /> Department Head or City Council has determined that conviction of a crime may relate <br /> directly to the position sought. The Police Department may not perform a background <br /> investigation unless the applicant consents in writing to the investigation and to the <br /> release of information to the City Staff as appropriate. An applicant's failure to provide <br /> consent may disqualify the applicant for the position sought. In the event of a <br /> questionable identity, where it is not clear if a record is based on name and date of birth <br /> or actually belongs to the applicant, the applicant's identity will be determined by the <br /> submission of fingerprint cards to compare against the actual arrest record. In <br /> administering this section,the City of Pequot Lakes will comply with Minnesota Statutes, <br /> Chapter 364,as amended, as may be applicable. <br /> Amendment. Chapter 5, Article 4, Section 5-4.1 —Criminal history background <br /> investigations, shall be repealed as follows: <br /> Section 5-4.1. CRIMINAL HISTORY BACKGROUND INVESTIGATIONS. <br /> The Crow Wing County Sheriff's Department on behalf of the Pequot Lakes Police <br /> Department is authorized to conduct a criminal history background investigation on <br />
