Camnliance Reauired. Every use pernutted by this Chapter shatl be so <br />esta.blished and maintained as ta comply with the provisions of tlus <br />secfion. The Planning Cammission may �equire the co�plaining party to <br />pravide such tests or investigations by an independent testing organization <br />satisiactory to the Planning Commission as are ne.cessary to show non- <br />compliance with these standards. The entire cost of such investigations <br />and fests sha�i �e paid for by the compiaini»g party wiless the resuits <br />disclose non-compliance with these standards; in that event, the entire cost <br />shall be borne by the o�ner or operator. This provisiQn cioes not preclude <br />the City from making any investigations and tests it finds appropriate to <br />determine compliance with these standards. <br />B. Noise. Naise sha11 be measured on any properiy line of the tract on which <br />t.�ie source of the noise is located. Noise sha11 be muf�led so as not to <br />b�;ome objectionable due to internuttence, beat frequency, shrillness, or <br />intensity. At the properiy line of the tract on which the source of noise is <br />loca.ted, the sound pressure level of noise radiated sha11 not �ceed the <br />following limits measwed for 10% (L10) and 50% (L50} of a one hour <br />period, using a sound level meter having the characteristics as specified in <br />standazds endorsed by the American National Standards Instite�te, <br />specification for sound level meters, and using procedures approved by the <br />State of 1Vlinnesota Follution Contrvl Agency.
