6. The City may also petition the District Court for a Court Order requiring <br /> the owner to connect to the public sanitary sewer system and ordering the owner <br /> to connect within a reasonable amount of time to be established by the Court, or <br /> for an Order authorizing the City to make the connection. In the event the City <br /> petitions the Court for an Order directing the connection, either by the owner or <br /> the City, the owner shall be liable for all costs of enforcement including court <br /> costs and reasonable attorney's fees related to said action. <br /> 7. Violation of any provision of this Ordinance, including an owner's failure <br /> to connect to the public sanitary sewer system, shall constitute a misdemeanor <br /> offense, and shall be punishable upon the conviction thereof in accordance with <br /> the laws of the State of Minnesota thereunto appertaining. An owner found in <br /> violation shall be liable for the City's legal fees and expenses incurred therein. <br /> Section 15-1.5. RESPONSIBILITIES AND OWNERSHIP <br /> 1. City Responsibility. The City shall maintain ownership of the sewer main <br /> and keep it in good working order. <br /> 2. Property Owners Responsibility. Property owners shall bear responsibility <br /> for their sewer system service connection beginning at the saddle of the sewer <br /> main facing their property line and ending with their residential pipes. The cost <br /> of installation, maintenance, repair, replacement or abandonment is a part of that <br /> L responsibility. <br /> Section 15-1.6. PRIVATE WASTEWATER DISPOSAL <br /> 1. Where a public sewer is not available under the provisions of this Chapter, <br /> the building sewer shall be connected to a private wastewater disposal system <br /> complying with the provisions of this Article. <br /> 2. Prior to commencement of construction of a private wastewater disposal <br /> system, the owner(s) shall first obtain a written permit signed by the City. The <br /> application for such permit shall be made on a form furnished by the City, which <br /> the applicant shall supplement by any plans, specifications, and other information <br /> as are deemed necessary to the City. <br /> 3. A permit for a private wastewater disposal system shall not become <br /> effective until the installation is completed to the satisfaction of the City or its <br /> authorized representative. The City or its representative shall be allowed to <br /> inspect the work at any stage of construction, and, in any event, the applicant for <br /> the permit shall notify the City when work is ready for final inspection, and <br /> before any underground portions are covered. The inspection shall be made <br /> within 24 hours of the receipt of notice. <br />
