B. A thorough evaluation of the property and structure reveals no <br /> reasonable location for a deck or platform which meets or exceeds <br /> the setback from the ordinary high water level. <br /> C. The deck encroachment toward the ordinary high water level does <br /> not exceed fifteen (15) percent of the existing setback of the <br /> structure from the ordinary high water level or does not encroach <br /> closer than the shore impact zone, whichever is more restrictive. <br /> D. The platform encroachment toward the ordinary high water level <br /> does not encroach closer that thirty (30) feet and does not exceed <br /> four hundred(400) square feet in size. <br /> E. The deck is constructed primarily of wood, and is not roofed or <br /> screened. <br /> F. The deck does not exceed ten(10) feet in height, from ground level <br /> and must not exceed eight (8) feet above grade, which is <br /> determined to be at the foundation; and cannot occupy an area <br /> greater than 250 square feet. <br /> G.
