ORDINANCE NO. 09-04, SECOND SERIES <br /> �. AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY CODE <br /> RELATING TO ADMINISTRATIVE CITATIONS <br /> FOR CERTAIN TRAFFIC OFFENSES <br /> CITY OF PEQUOT LAKES <br /> COUNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent. The purpose and intent of this ordinance amendment is to amend <br /> Chapter 7 of the Pequot Lakes City Code to authorize Administrative Citations for <br /> Certain Traffic Offenses Pursuant to Minn. Stat. § 169.999 within the City of Pequot <br /> Lakes. <br /> Amendment. Chapter 7, Article 1, Section 7-1.1 and 7-1.11 shall be added as follows: <br /> CHAPTER 7—GENERAL OFFENSES <br /> ARTICLE 1. THE ENFORCEMENT OF ADMINISTRATIVE OFFENSES AND <br /> ISSUANCE OF PENALTIES RELATED TO THESE OFFENSES <br /> Section 7-1.1. PURPOSE <br /> Administrative offense procedures established pursuant to this Section are intended to <br /> provide the public and the City of Pequot Lakes with an informal,cost effective, and <br /> expeditious alternative to traditional criminal charges for violations of certain City Code <br /> and Ordinance provisions. The procedures are intended to be voluntary on the part of <br /> those who have been charged with administrative offenses. At any time prior to payment <br /> of the administrative penalty as is provided for thereafter,the individual may withdraw <br /> from participation in the procedures, in which event the City may bring criminal charges <br /> in accordance with law, likewise,the City of Pequot Lakes in its discretion may choose <br /> not to initiate an administrative offense and may bring criminal charges in the first <br /> instance. In the event a party participates in the administrative offense procedures but <br /> does not pay the monetary penalty which may be imposed,the City of Pequot Lakes will <br /> seek to collect the costs of the administrative offense procedures as part of a subsequent <br /> criminal sentence in the event the party is charged and is adjudicated guilty of the <br /> criminal violation. Any minor traffic offense subject to an administrative fine set forth in <br /> Section 7-1.1 l shall be governed by that section. <br /> Section 7-1.11 ADMINISTRATIVE CITATIONS FOR CERTAIN TRAFFIC <br /> OFFENSES PURSUANT TO MINN.
