ORDINANCE NO.09-04, SECOND SERIES AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY CODE RELATING TO ADMINISTRATIVE CITATIONS FOR CERTAIN TRAFFIC OFFENSES CITY OF PEQUOT LAKES COUNTY OF CROW WING STATE OF MINNESOTA The City Council of the City of Pequot Lakes does ordain as follows: P_uMose and Intent. The purpose and intent of this ordinance amendment is to amend Chapter 7 of the 'Pequot Lakes City Code to authorize Administrative Citations for Certain Traffic Offenses Pursuant to Minn. Stat. § 169.999 within the City of Pequot Lakes. Amendment. Chapter 7, Article 1, Section 7-1.1 and 7-1.11 shall be added as follows: CHAPTER 7—GENERAL OFFENSES ARTICLE 1. THE ENFORCEMENT OF ADMINISTRATIVE OFFENSES AND ISSUANCE OF PENALTIES RELATED TO THESE OFFENSES Section 7-1.1. PURPOSE Administrative offense procedures established pursuant to this Section are intended to provide the public and the City of Pequot Lakes with an informal, cost effective, and expeditious alternative to traditional criminal charges for violations of certain City Cade and Ordinance provisions. The procedures are intended to be voluntary on the part of those who have been charged with administrative offenses. At any time prior to payment of the administrative penalty as is provided for thereafter,the individual may withdraw from participation in the procedures, in which event the City may bring criminal charges in accordance with law, likewise,the City of Pequot Lakes in its discretion may choose not to initiate an administrative offense and may bring criminal charges in the first instance. In the event a party participates in the administrative offense procedures but does not pay the monetary penalty which may be imposed,the City of Pequot Lakes will seek to collect the costs of the administrative offense procedures as part of a subsequent criminal sentence in the event the art is char ed_and is ad'udicated it of the criminal violation.
