That photographs documenting the accumulation of garbage,junk, vehicles, mobile <br /> homes, structures, and other debris on the premises of the Property are attached <br /> hereto as Exhibit B. <br /> 4. That the accumulation of such garbage,junk, vehicles, mobile homes, structures, and <br /> other debris, and excessive numbers of animals on the premises of the Property is in <br /> such quantities as to unreasonably annoy, injure, or endanger the safety, health, <br /> morals, comfort, or repose of the public. <br /> 5. That the accumulation of such garbage,junk, vehicles, mobile homes, structures, and <br /> other debris, and excessive numbers of animals on the premises of the Property is in <br /> such quantities as to be indecent or offensive to the senses, and an obstruction of the <br /> free use of property, so as to interfere with the comfortable enjoyment of life or <br /> property of the public. <br /> NOW, THEREFORE, the Pequot Lakes City Council makes the following: <br /> CONCLUSIONS AND ORDER <br /> A. That the accumulation of garbage,junk, vehicles, mobile homes, structures, and other debris, <br /> and excessive numbers of animals at the Property constitutes a public nuisance. <br /> And <br /> �-' B. That the property owner shall have until 11:00 a.m. on Tuesday, June 17, 2014 to remedy the <br /> nuisance conditions and code violations existing on the Property. <br /> And <br /> f <br /> C. That if the property owner shall fail to remedy the nuisance conditions and code violations on <br /> or before the time specified in Paragraph B,the City staff and City Attorney shall take all <br /> appropriate actions and initiate any and all legal proceedings necessary to abate the nuisance <br /> and remedy the code violations, assess the costs of such abatement against the Property, and <br /> if warranted in the discretion of the City Attorney, initiate criminal prosecution for each <br /> documented violation of the City Code. In the event the City's prosecuting attorney is <br /> unwilling or unable to prosecute such offenses, the City's civil City Attorneys, Flaherty& <br /> Hood, P.A., are authorized to initiate and pursue to completion such prosecution(s). <br /> Dated this day of , 2014 <br /> Nancy Ad <br /> Mayor <br /> 3 <br />
