Prepared by the S.P. 1810-92 (T.H. 371) <br /> Utility Agreements and Permits Unit Location: from 0.5 mi. north of CSAH 18 in <br /> ($0.00) Nisswa to 0.5 mi. north of CSAH 16 in <br /> No Cost Jenkins in Crow Wing County, Minnesota <br /> Utility Owner: City of Pequot Lakes <br /> MnDOT Agreement Number 1000912 <br /> S.P. 1810-92 (T.H. 371) <br /> DESIGN-BUILD PROJECT <br /> MASTER UTILITY AGREEMENT WITH <br /> THE CITY OF PEQUOT LAKES <br /> THIS MASTER UTILITY AGREEMENT (MUA) is made and entered into this day of <br /> 2015 among the State of Minnesota, acting through its <br /> Commissioner of Transportation, (MnDOT); the City of Pequot Lakes, acting through its City <br /> Council, and including all of its agents, contractors, and subcontractors (Utility Owner); and <br /> , a [joint venture] f Corporation] (partnership], <br /> including all of its agents, contractors, and subcontractors (Contractor). <br /> RECITALS <br /> MnDOT has entered into a design-build contract (DB Contract) with the Contractor to design <br /> and construct State Project Number 1810-92 on Trunk Highway Number 371 (Project). The <br /> Project is located on T.H. 371 from 0.5 mi. north of CSAH 18 in Nisswa to 0.5 mi. north of CSAH <br /> 16 in Jenkins in Crow Wing County, Minnesota. The Project includes construction of a new <br /> four-lane, divided expressway along 9 miles of roadway with improved access, as well as a by- <br /> pass to the east of Pequot Lakes with a new interchange at CSAH 11. <br /> The Utility Owner owns and operates a buried, forcemain sanitary sewer, its fixtures, and related <br /> equipment (Facilities) inside the limits of the Project. The Project may cause changes to the <br /> Facilities. These changes may include relocation work, protection in place, removal, <br /> replacement, reinstallation, and/or modification of the Facilities. <br /> MnDOT will reimburse the Utility Owner for the costs of the Utility Work that the Project causes <br /> to Facilities that are located where the Utility Owner owns a real property interest (fee, <br /> easement). The Utility Owner must submit documentary proof of that interest for MnDOT <br /> Approval. <br />
