MnDOT Contract No: 1001092 Parcel 6 is described further as follows: That part of Tract A described below: Tract A. The Northeast Quarter of the Southwest Quarter of Section 14,Township 136 North, Range 29 West,Crow Wing County, Minnesota, except a strip of land 1 rod wide running east to west along the entire north side of said Northeast Quarter of the Southwest Quarter for road purposes; which lies easterly and southerly of Line 1 described below: Line 1. Beginning at Right of Way Boundary Corner B11005 as shown on Minnesota Department of Transportation Right of Way Plat No. 18-111 as the same is on file and of record in the office of the County Recorder in and for said County;thence northeasterly on an azimuth of 11 degrees 43 minutes 50 seconds along the boundary of said plat for 1358.81 feet to Right of Way Boundary Corner B15;thence on an azimuth of 90 degrees 25 minutes 14 seconds along the boundary of said plat for 272.88 feet to Right of Way Boundary Corner B14;thence on an azimuth of 179 degrees 21 minutes 34 seconds along the boundary of said plat for 17.00 feet to Right of Way Boundary Corner B 13;thence on an azimuth of 90 degrees 25 minutes 14 seconds along the boundary of said plat for 100.02 feet to Right of Way Boundary Corner B 12 and the north and south quarter line of said Section 14 and there terminating. 2.3 State's Conveyance. The State will convey Parcel 246 and Parcel 6 to the City, at no cost or expense to the City, in fee simple estate by quitclaim deed. 2.4 Conveyance Documents. The State will be responsible for providing legal descriptions and for preparing conveyance documents. All conveyance documents must be approved, prior to their execution, by the State's District 3 Right-of-Way Engineer or his/her designee.The State will execute and deliver the conveyance documents to the City. 2.5 Timing of Conveyance. Upon State's completion of the Project,the State will convey Parcel 246 and Parcel 6 pursuant to Article 2.3 of this Agreement. 2.6 Recording. The City will be responsible for recording the conveyance instruments in the office of the Crow Wing County Recorder. 2.7 Environmental Liability. Nothing in this Agreement is intended to alter any responsibility imposed by applicable federal or state environmental protection laws, specifically including but not limited to, laws governing responsibility for cleanup of polluted properties. 3 System Mitigation 3.1 Reconstruction or Relocation Obligation. The City will reconstruct or relocate the System before August 1, 2016 in order to accommodate the Project. If any portion of the System will remain on the State's trunk highway right-of-way corridor after August 1, 2016,the City must take the following actions: 3.1.1 Submit the plans for the reconstruction or relocation of the System for State approval before the reconstruction or relocation work begins. If any changes must be made to the plans,the State must approve these changes in writing before the City performs any work; and -3- Joint Powers Agreement for Non Professional/Technical Services(CM 06/19/2012)
