COMMUNI'T'Y C1ry Of <br /> GROW irn P "Ofi <br /> INSTITUTE els- <br /> STAFF REPORT <br /> Application: Ordinance Amendment Regarding Appeal Timeframes <br /> Applicant: City of Pequot Lakes <br /> Agenda Item: 4(b) <br /> Background Information: The Zoning Ordinance currently does not have an appeal <br /> timeframe for decisions made by the Zoning Administrator, or the Planning <br /> Commission/Board of Adjustment. <br /> Since a timeframe for appeals is not given, an applicant that has been approved for <br /> something may be unsure whether or not the approval they have been given will be <br /> appealed. A deadline for appeals would give applicants assurance their approval will not <br /> be reversed. <br /> The Planning Commission shall determine an adequate timeframe in which an appeal <br /> must be filed. The City Attorney suggests an appeal timeframe of at least fifteen days, <br /> which is consistent with amount of time an appeal must be filed for plats per Section 11.9 <br /> "Subdivisions": <br /> 6. Preliminary Plat or Preliminary Condominium Plat Approval. <br /> H. The City Council will hear any appeal within thirty (3o) days of the Planning <br /> Commission action and will re-notify anyone noticed for the Public Hearing. Said <br /> `- appeals will be filed with the City Clerk within fifteen(15)days of the decision. <br /> Planning Commission Direction: The Planning Commission may either recommend <br /> that the application be approved or denied, with or without changes to the text provided <br /> here. <br /> Staff Recommendation: Fifteen days seems to be an adequate amount of time for an <br /> appeal to be filed. We recommend the ordinance amendment be forwarded, as written, <br /> to the City Council for adoption. <br /> Pequot Lakes Staff Report 4(b)-1 <br /> September 20,2012 <br />
