12. The former parsonage and garage are allowed. <br /> 13. The screening in the area adjacent to the highway shall be augmented with <br /> additional coniferous trees. <br /> Section 11.9, Subdivision 6C outlines the procedure to follow when reviewing a final plat <br /> application and directs the Planning Commission to consider the following: <br /> 1. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned wither through performance or <br /> execution of appropriate agreements assuring performance? <br /> 2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> 3. Does the City Attorney agree that all parties with an interest in the property are <br /> shown as signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily <br /> completed or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document <br /> meets the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings:The Staff provides the following findings of fact for consideration: <br /> i. The applicant has complied with all of the conditions of the conditional use <br /> permit. There were no conditions of the preliminary plat approval. <br /> 2. A plat check for the development has not been submitted to the City. <br /> 3. The City Attorney has not indicated that adequate title insurance has been <br /> provided to assure all parties with an interest are represented. <br /> 4. There are no required improvements with this subdivision. <br /> 5. An independent land surveyor has not verified that the final document meets the <br /> statutory requirements. <br /> 6. No financial security is required. <br /> Planning Commission Direction: The Planning Commission should develop <br /> findings to recommend approval of the final plat. In general, the Commission cannot <br /> deny a final plat unless the applicant will not or cannot meet the final platting <br /> requirements or the conditions of the preliminary plat approval.The Commission cannot <br /> impose additional conditions that do not fall directly within the guidelines of the final <br /> plat or relate directly to conditions imposed in the preliminary plat. <br /> Staff Recommendation: Even though the platting of the SuperValu property is <br /> somewhat of a "formality," all the requirements of the ordinance for final platting need <br /> to be met. The applicants requested to have both the preliminary and final flat <br /> applications on the November agenda in order to streamline the applications. We see no <br /> reason why the proposed plat can't be approved at the next council meeting if the <br /> following items are completed before then: <br /> 1. A plat check for the development is submitted to the City,indicating the final plat <br /> agrees with and is consistent the approve preliminary plat. <br /> 2.
