9. The proposed side lot lines are at right angles to the existing road line and the <br /> property line of the adjacent property. <br /> io. Each of the proposed parcels contains more than 33-feet of frontage on public <br /> right-of-way. <br /> ii. Each of the proposed properties meets the requirements of the code for <br /> stromwater management. <br /> 12. There are no public streets proposed within the development. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> metes and bounds subdivision, deny the metes and bounds subdivision, or table the <br /> request if additional information is needed. If the motion is for approval or denial, <br /> findings of fact should be cited. <br /> Staff Recommendation: The current configuration of the property is unique for <br /> multiple reasons. The property is divided by a public roadway and it also contains <br /> multiple"island parcels"that are owned by different property owners. <br /> The proposed subdivision (and rezones) "clean-up" some of the issues with the subject <br /> property. We recommend the proposed subdivision be approved only if the proposed <br /> rezoning(Application 13-4187)of the property is approved by the City Council. <br /> *It should be noted the original subdivision and rezoning applications for the subject <br /> property contained only two parcels. "Tract B" and the "Remainder Tract" were <br /> combined as one io acre parcel with two zoning classifications (Rural Residential and <br /> Commercial). Staff recommended to the property owner that in order to resolve some of <br /> the issues with the property, those two parcels should be separate. Staff informed the <br /> property owner it would be difficult for the City to approve a newly created single lot <br /> with two zoning classifications and with a public road dividing it.
