Lots requiring variances to allow their use for the intended purposes or <br /> requiring holding tanks for sewage shall not be allowed. <br /> Staff Findings:The Staff provides the following findings of fact for consideration: <br /> 1. The subject property is located at 31343 North Oak Street and is zoned Shoreline <br /> Residential. <br /> 2. Both of the proposed tracts meet the requirements of the Shoreline Residential <br /> Zone. <br /> 3. "Tract A" contains a conforming single family dwelling and two conforming <br /> accessory structures. "Tract B" contains an existing dwelling, two conforming <br /> accessory structures and a pre-existing water oriented structure that is located <br /> within the lake setback. <br /> 4. Both of the proposed tracts contain conforming private sewer systems. "Tract A" <br /> contains a deep water well and"Tract B"contains a shallow water well. <br /> 5. The property is suitable in its natural state for the intended purpose and this lot <br /> split would not be harmful to the health, safety, or welfare of future residents or <br /> of the community. <br /> 6. The proposed subdivision will increase the number of properties on the Sibley <br /> Lake but will not significantly increase the demand for water-based recreation as <br /> the number of dwellings is not increasing. <br /> 7. The proposed lot layouts meet the requirements of the ordinance. <br /> 8. The proposed side lot lines are at right angles to the existing road line and the <br /> property line of the adjacent property. <br /> 9. Each of the proposed parcels contains more than 33-feet of frontage on public <br /> right-of-way. <br /> lo. Each of the proposed properties meets the requirements of the code for <br /> stromwater management. <br /> il. There are no public streets proposed with this request. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> metes and bounds subdivision, deny the metes and bounds subdivision, or table the <br /> request if additional information is needed. If the motion is for approval or denial, <br /> findings of fact should be cited. <br /> Staff Recommendation: The proposed configuration and layout of the properties <br /> meet the requirements of the code. We recommend the application be approved with <br /> one condition: <br /> 1. An access easement shall be created and filed with Crow Wing County allowing <br /> "BLDG #1" to be accessed by the property owner of "Tract B" via the existing <br /> driveway on"Tract A." <br /> Pequot Lakes Staff Report 7(b)_5 <br /> June 20,2013 <br />
