Box 466,Nisswa,MN 56468 July 25, 2013 Dawn Bittner Pequot Lakes Zoning Administrator 4638 County Road 11 Pequot Lakes, MN 56472 Dear Ms.Bittner: The Cullen Lakes Association(CLA)has become aware of at least two potential violations at the Wilderness Resort Villas on Middle Cullen Lake. I believe Paul Reichenbach,a Middle Cullen resident,provided you with photos regarding these violations. He has also given me,as chair of the CLA Land Development Committee and CLA president,copies of these photos. The violations I believe the photos show are as follows. *The photos of vehicles parked along the shoreline and the obvious motorized use of the "former"road are in violation of Condition#12 of the August 19,2010 conditions of approval: "The road in the bluff and shoreline setback shall be removed and re-vegetated. An 8-foot wide walking trail may replace the road; however, all automobile traffic shall be banned. The walking trail shall be constructed with pervious materials." This is also referred to in the May 19,2011 Findings of Fact(l.f.a.i)of the Final Plat staff report: "Restore and preserve all areas within the shore impact zone outside of the beach(my note: this beach was not allowed)and picnic area, except for a 8-foot walkways(sic)to the docking areas." *The photos of the docking which show mooring areas in the bulrushes indicate a violation of Condition#11 of the April 17, 2008 PUD approval: "The placement of the docks shall be done at the direction and recommendation of the Department of Natural Resources." I also refer you to#38 of the April 17,2008 staff report on the PUD maintenance and design criteria: "The mooring sites are proposed in three sections on both sides of the peninsula. The slips are outside of the emergent vegetation identified on the site." (bold print added by me). In an April 3,2005 letter from Tim Brastrup, then Areas Fisheries Supervisor,Brainerd,to Ron Morreim,then Area Hydrologist,Brainerd,he discusses the importance of hardstem bulrush to the lake's fisheries and in providing critical shoreline habitat for birds and other aquatic mammals.
