City of <br /> Pequot <br /> Lakes=-- <br /> September 11, 2013 <br /> Patrick Smith and <br /> Robert Rickard <br /> 6187 Sugarbush Trail <br /> Brainerd, MN 56401 <br /> Re: Preliminary Plat of Timber Ridge <br /> Dear Mr. Smith and Mr. Rickard : <br /> Please be advised that on September 3, 2013, the City Council accepted the <br /> Planning Commission's recommendation to approve the Preliminary Plat of <br /> Timber Ridge based on the following Findings of Fact: <br /> 1. The applicant is proposing to subdivide the property located at 30827 <br /> Pequot Boulevard into three residential lots and two outlots. <br /> 2. The property is currently zoned "Shoreline Commercial," but the property <br /> owner has submitted a request for it be rezoned to "Shoreline Residential." <br /> 3. The land is properly zoned (if rezoning application 13-4215 is approved) in <br /> its natural state for the intended residential purposes. <br /> 4. The subject property contains a non-conforming structure on proposed <br /> "Lot 3" (attached deck on the principal structure encroaches in the bluff <br /> setback). Proposed "Outlot A" contains an accessory structure which <br /> encroaches into proposed "Lot 1." <br /> 5. Proposed Lots 14' contain adequate contiguous lawn area for the <br /> construction of two standard private sewer systems. "Outlot A" and "Outlot <br /> B" will be consolidated with adjacent properties that already contain <br /> private sewer systems. <br /> 6. Proposed Lots 14' conform to the minimum requirements of the <br /> "Shoreline Residential" zone. <br /> 7.
