City Of <br /> ROI e uGWM <br /> INSTITUTE <br /> NEW BUSINESS- BYRNE ACCESSORY STRUCTURE HEIGHT <br /> Background Information: In September 2012, a land use permit was issued to a <br /> property owner to construct an accessory structure on the property located at 4905 <br /> Olson Road. The subject property is located on the north side of East Twin lake and is <br /> zoned"Shoreline Residential." <br /> Staff has determined the height of the structure exceeds the maximum height allowed for <br /> accessory structures in the "Shoreline Residential" zone. During an onsite visit, it was <br /> determined the sidewall height is 9 feet(8'sheet of plywood on a 1'block). The applicant <br /> has indicated the peak height of the structure is 17' 8". The distance from the top of the <br /> sidewall (eves) to the peak is 8'8" so the midpoint is 4'4" above the 9' sidewall. The <br /> overall height of the structure, as defined by the ordinance, is 13'4". <br /> Staff is seeking Planning Commission direction on how to proceed. The property owner <br /> has been notified the Planning Commission will be discussing the situation. <br /> Section 17-3.2. DEFINITIONS <br /> 45. Building Height. The vertical distance between the highest adjoining <br /> ground level at the building or ten(10) feet above the lowest ground level, <br /> whichever is lower, and the highest point of a flat roof or average height <br /> between the eaves and the highest ridge of gable, hip or gambrel roofs or <br /> ten feet below the peak, whichever is greater. <br /> Section 17-5.8 SHORELINE RESIDENTIAL (SR) <br /> Building height,accessory structure-feet,maximum 13 <br /> Pequot Lakes Staff Report 7(b)-1 <br /> September 19,2013 <br />
