Fil I <br /> INSTITUTE <br /> Toll Free 866.900.3064 Fax 866.924.1928 <br /> October 3, 2013 <br /> James Byrne <br /> 3527 Pilgrim LN N <br /> Minneapolis,MN 55441 <br /> RE: Accessary Structure Height <br /> City of Pequot Lakes <br /> Mr. Byrne: <br /> The City has determined the accessory structure you are constructing on your property at 4905 <br /> Olson Road in Pequot Lakes exceeds the maximum height allowed for an accessory structure in <br /> the"shoreline residential"zone. <br /> The land use permit issued on September 7, 2012 states, `Building height shall not exceed 13 <br /> feet as defined in the City Code." According to the measurements you provided to staff at the <br /> most recent site visit, we have determined the height of the structure (as defined by the <br /> ordinance)to be 13 feet 4 inches. <br /> The Planning Commission has identified two possible solutions to rectify the situation: <br /> 1) Alter the structure so it meets the 13 ft. maximum height requirement. <br /> 2) Obtain an after-the-fact variance to exceed the maximum height allowed for an accessory <br /> structure in the "shoreline residential' zone. The application fee for a "residential <br /> variance" is $350 + $46 recording fee. If approved, an "after-the-fact" fee for a <br /> permitted structure(5 times base fee with a minimum $300 penalty may apply). <br /> We have enclosed our staff report to the Planning Commission which demonstrates how the <br /> structure height was calculated.
