84 Mr. Steffens stated that grading for the beach will exceed 50 cubic yards. Said the <br /> 85 ordinance will need to be amended to additional grading on commercial properties or <br /> 86 they will need to file for a variance to exceed 50 cubic yards of grading. <br /> 87 <br /> 88 Public Comment Closed. <br /> 89 <br /> 90 MOTION BY COMMISSIONER HABEIN SECONDED BY COMMISSIONER <br /> 91 ORASKOVICH TO RECOMMEND APPROVAL OF FINAL PLAT OF WILDERNESS <br /> 92 RESORT VILLAS, THIRD AMENDED BASED ON THE FOLLOWING FINDINGS OF <br /> 93 FACT AND NO CONDITIONS.ALL MEMBERS VOTED"AYE."MOTION CARRIED. <br /> 94 1. There were no conditions of approval for the preliminary plat other than <br /> 95 those included with the March 20, 2014 CUP approval. The applicant has <br /> 96 complied with the applicable conditions of the conditional use permit that <br /> 97 were required to be completed before final plat approval. Specifically, in <br /> 98 reference to the Conditional Use Permit approval of March 20, 2014,we find <br /> 99 the following: <br /> 100 a. Conditions numbered one through four apply to the lodge building and <br /> 101 are not applicable to the final plat process. <br /> 102 b. Condition number five applies to the docking systems and does not <br /> 103 apply to the final plat process. <br /> 104 c. Conditions six through 15 pertain to the beach and"picnic"areas. The <br /> 105 design of the beach and "picnic" area conforms with the approved <br /> 106 conditions. Stormwater management plans have been updated to <br /> 107 include a berm and drainage area north of the beach area. <br /> `,108 d. Conditions 16 and 17 pertain to the relocation of the boat ramp and are <br /> 109 not applicable to the final plat process. <br /> 110 e. Conditions 18-21 pertain to the road in the shore impact zone and do <br /> 111 not specifically apply to the final plat process. <br /> 112 f. Condition 22:A vegetation/screening plan has been submitted. It must <br /> 113 be approved by the Planning Commission before construction <br /> 114 activities commence. <br /> 115 g. Condition 23:A lighting plan has been submitted. It must be approved <br /> 116 by the Planning Commission before construction activities commence. <br /> 117 h. Condition 24: An acceptable professional stormwater management <br /> 118 plan has been submitted. <br /> 119 i. Condition 25: The previous beach area on the east side of the point has <br /> 120 been re-vegetation. The area will be used as a"picnic area"as approved <br /> 121 by the City. <br /> 122 2. Minor alterations have been made to the plat since the preliminary plat has <br /> 123 been approved. The Planning Commission has determined said changes are <br /> 124 not significant and they do not warrant a separate preliminary plat <br /> 125 amendment application. There are no significant changes to the overall <br /> 126 layout and design of the plat and the density and general configuration is the <br /> 127 same. <br /> 128 3. The City Attorney has reviewed the title commitment and determined that <br /> 129 quit claim deeds between Wilderness Resort Villas LLC and the owners of all <br /> 130 property impacted by the amendment shall be presented to the City prior to <br /> 131 the city approving the final plat. <br /> Minutes 3 <br /> Pequot Lakes Planning Commission <br /> September 18, 2014 <br />
