I am willing to meet with you on-site once again, if you feel that would be helpful. However,at the time of our last site visit,which was a full growing season after the cutting took place,the area in question had not regrown. Since bulrush do not grow back later than within a regular growing season, I can assure you these plants have not regrown. Also,to clear up some apparent confusion, "cutting" is considered a form of"removal", unless you are referring to the fact that the cut plants were not collected, but allowed to drift in the lake. We can use the term "mechanical control"or perhaps "illegal mechanical control"from this point forward if that would be more meaningful for you, since it is more inclusive. I have included the definition of mechanical removal for your convenience. This is a "cut and paste"version from the same version that you have obtained and referenced in the past: Subp. 9a. Mechanical control. "Mechanical control" means cutting, pulling,raking,or otherwise removing or altering aquatic plants by physical means, including by hand and motorized or nonmotorized equipment. Incidental damage caused to aquatic plants by watercraft traveling to and from open water, commercial harvesting of aquatic plants,transplanting aquatic plants,moving a bog,and harvesting aquatic plants for personal use are not mechanical control. Let me know a few options as to dates to meet on-site, if you wish to do so. Rob,since this is an Enforcement issue, it may be helpful for you to attend as well, if your schedule allows. Thank you. A drawing of the system is attached. With respect to the bulrushes, as I indicated, we believe that all the bulrushes which were cut (none were removed) have regrown and I believe a close examination of the area as well as a review of numerous before and after photographs that I have will demonstrate that fact. I suggest we have another onsite meeting and look at the bulrushes, together with the location of the new boat ramp. A copy of the drawing showing the location of the ramp, surrounding trees as well as the existing cabin ind proposed new townhomes to be constructed is attached. Thank you for your assistance. i
