15. Boat canopies shall be of dark earth tone colors, such as dark green. 16. Storage units shall be of earth tone colors. 17. The requested second beach is not allowed as part of this approval. 18. The applicant shall apply for pool inspection by the Department of Health as per State Statutes. The City shall be copied with the application. The pool must not be placed into public use until the Health Commissioner's inspection shows compliance with Minnesota Rules,parts 4717.0150 to 4717.3975. Chairman Woog directed Staff to update Finding of Fact#36 for the motion. Chairman Woog called for the vote: Mr.Hallan abstained,Mr. Derksen voted"nay". Motion carried 5 ayes— 1 nay. The Conditional Use Permit is back open: Mr. Steffens stated that it is not as important to build the lodge now as the amenities building. The Planning Commission suggested that no additional building permits in excess of 20 will be issued unless the amenities building is constructed and operational. The 21 st unit will be the trigger;40 units for the lodge construction. PUBLIC COMMENT: Paul Reichenbach,27188 Sarah Lane, asked if the units were single family units or structures. Sue Moore, 90302 Seminol Bay,Pequot Lakes—Is there any consideration to those people already there? Who is financially responsible to keep up the amenities building? Mr. Marohn explained there are 60 owners after it is all done;now there are 9 owners plus 1 owner who owns 51. A motion was made by Tom Adams, seconded by Mark Hallan,to add an additional Condition to the Conditional Use Permit previously approved stating: 19.No additional building permits will be issued after 20 until the amenities building is constructed and operational and, in addition,no additional building permits will be issued after 40 units are built until the lodge is constructed and operational. Chairman Woog called for the vote: 6 ayes, 1 nay(John Derksen). Motion carried. 9
