As of August 2013, the road in the bluff and shoreline setback had not been <br /> removed as per previous CUP approval. <br /> 16. [The Planning Commission should determine if motorized usage of the proposed <br /> path meets CUP criteria and create a finding of fact that supports their decision.] <br /> 17. The applicant is proposing to utilize "golf cart parking" areas outside of the shore <br /> impact zones and bluff impact zones. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> conditional use permit amendment, deny the application, or table the request if <br /> additional information is needed. If the motion is for approval or denial, findings of fact <br /> should be cited. <br /> Staff Recommendation: We recommend the conditions of approval from the original <br /> CUP application (attached) remain part of the permit. We also recommend <br /> consideration of the following for the CUP amendment: <br /> The Lodge: <br /> 1. Before commencement of construction activities, a condominium plat for the <br /> lodge shall be approved by the City. <br /> 2. An acceptable updated plan for the vegetative screening of the lodge (as viewed <br /> from the lake) shall be submitted to the Planning Commission before it may be <br /> �.. constructed. <br /> 3. In order to preserve the character of the neighborhood and the surrounding area, <br /> the height of the lodge may not exceed"X"feet. <br /> The Docking Systems: <br /> 4. The number and location of docking systems shall remain the same as previously <br /> approved. <br /> 5. Before the docking systems are placed in the water, proper authorization shall be <br /> obtained from the Minnesota Department of Natural Resources. <br /> Beach Areas: <br /> 6. The applicant shall demonstrate with professional grading and drainage plan how <br /> untreated runoff will be prevented from entering the lake via the proposed beach <br /> area(s). <br /> 7. In order to minimize negative impacts on Middle Cullen Lake, one centralized <br /> beach area shall be allowed on the subject property. The existing beach may be <br /> expanded to 130'in width. <br /> 8. Grading in the vicinity of the beach area(s) shall include the use of berms, swales <br /> and natural vegetation near the beach areas. <br /> 9. Necessary permits shall be obtained from the DNR for the removal of any aquatic <br /> vegetation for the creation of the beach areas. <br /> If the beach on the beach on the east side of the point is allowed: <br /> L <br /> Pequot Lakes Staff Report 4(a)-10 <br /> February 20,2014 <br />
