C'ommulvi 1 y Ggy'f <br /> GR Pegjuot' _ <br /> INSTITUTE Ld.des� <br /> NEW BUSINESS- BYRNE ACCESSORY STRUCTURE HEIGHT <br /> Background Information: In September 2012, a land use permit was issued to a <br /> property owner to construct an accessory structure on the property located at 4905 <br /> Olson Road. The subject property is located on the north side of East Twin lake and is <br /> zoned"Shoreline Residential." <br /> It has been determined the height of the structure exceeds the maximum height allowed <br /> for accessory structures in the"Shoreline Residential'zone. <br /> In December 2013 Commissioner Hallan volunteered to conduct a site visit to verify the <br /> building height. He has also provided a drawing of his findings(attached). <br /> Mr. Byrne has been invited to the meeting to discuss options to remedy the situation. At <br /> a prior meeting two options were discussed: <br /> 1. Obtain an after-the-fact variance to exceed the maximum building height of an <br /> accessory structure in the Shoreline Residential Zone. <br /> 2. Alter the structure so the maximum height(as defined by ordinance) is 13 feet. <br /> Section 17-3.2. DEFINITIONS <br /> 45. Building Height. The vertical distance between the highest adjoining <br /> ground level at the building or ten(10) feet above the lowest ground level, <br /> whichever is lower, and the highest point of a flat roof or average height <br /> between the eaves and the highest ridge of gable, hip or gambrel roofs or <br /> ten feet below the peak, whichever is greater. <br /> Section 17-5.8 SHORELINE RESIDENTIAL (SR) <br /> Building height,accessory structure-feet,maximum 13 <br /> Pequot Lakes Staff Report 8(a)-1 <br /> March 20,2014 <br />
