Pequot Lakes Staff Report 7 (a) - 1 <br />November 19, 2015 <br /> <br /> <br />NEW BUSINESS – DAVID KENNEDY METES AND BOUNDS SUBDIVISION DISCUSSION <br /> <br />Agenda Item: 6 (c) <br /> <br /> <br /> <br /> <br /> <br /> <br />Background Information: David and Christine Kennedy applied to Rezone <br />the above 40 acre parcel to Rural Residential and a Metes and Bounds <br />Subdivision of the 5 acre tract indicated above in red. The Planning Commission <br />approved the subdivision November 20, 2014 with the condition the approval <br />would be null and void if the City Council did not approve the Rezone application. <br />The City Council approved the Rezone December 2, 2014. <br /> <br />Due to the negotiations with MN/DOT and the County, the City had agreed to <br />abandon the existing roadbed of County Road 112 north of the new County Road <br />112 where it turns northwest across the Rasmussen property. For Tract A, the 5- <br />acre parcel, to have 33 feet of public right-of-way, Tract A would need to include a <br />“flag” strip 33 feet wide along the westerly line of the subject property. A second <br />condition was added to the subdivision: <br /> 2. Applicant shall provide a new Certificate of Survey for Tract A that <br /> includes a 33-foot strip of land along the west boundary of this parcel to <br /> the location where it would meet the public right-of-way of the new <br /> County Road 112. <br />
