Pequot Lakes Staff Report 6 (a) - 1 <br />November 19, 2015 <br /> <br /> <br />NEW BUSINESS – JOHN BABINSKI PERMIT EXTENSION <br /> <br /> <br />Agenda Item: 6 (a) <br /> <br />Background Information: The late Donald Babinski received a Land Use <br />Permit in 2005 to construct 5 manufacturing buildings over a timeline for <br />completion by October 31, 2013. These buildings were not constructed. Mr. <br />Babinski paid the $5,000 maximum permit fee. <br /> <br />John Babinski has applied for a Land Use Permit to construct one 60’ X 502’ <br />building. The maximum fee for this building would be $5,000. John Babinski <br />has requested an extension of Land Use Permit No. 05-03. A permit extension <br />would result in a fee of $500, 10% of the original permit fee. <br /> <br />John Babinski’s request for the extension is attached. <br /> <br /> <br />Applicable Regulations: <br /> <br />Section 17-11.8 LAND USE PERMITS <br />7. Unless extended by the Zoning Administrator, where a Land Use Permit <br />has been issued but no action has occurred within 12 months, the Land Use <br />Permit shall be null and void. Exterior work on the structure shall be complete in <br />24 months from the issuance of the Land Use Permit. The time limit may be <br />extended up to six months by the Zoning Administrator for good cause. A second <br />extension shall be decided by the Planning Commission. <br /> <br />Planning Commission Direction: The Planning Commission can extend <br />Land Use Permit No. 05-03 with a fee of $500 or deny the extension of Land Use <br />Permit No. 05-03. If the extension is denied Staff will issue Land Use Permit No. <br />15-85 for the construction of the new building with a fee of $5,000. <br /> <br />Staff Recommendation: We recommend that the extension be approved. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
