Pequot Lakes Staff Report 6 (a) - 1
November 19, 2015

NEW BUSINESS – JOHN BABINSKI PERMIT EXTENSION

Agenda Item: 6 (a)

Background Information: The late Donald Babinski received a Land Use
Permit in 2005 to construct 5 manufacturing buildings over a timeline for
completion by October 31, 2013. These buildings were not constructed. Mr.
Babinski paid the $5,000 maximum permit fee.

John Babinski has applied for a Land Use Permit to construct one 60’ X 502’
building. The maximum fee for this building would be $5,000. John Babinski
has requested an extension of Land Use Permit No. 05-03. A permit extension
would result in a fee of $500, 10% of the original permit fee.

John Babinski’s request for the extension is attached.

Applicable Regulations:

Section 17-11.8 LAND USE PERMITS
7. Unless extended by the Zoning Administrator, where a Land Use Permit
has been issued but no action has occurred within 12 months, the Land Use
Permit shall be null and void. Exterior work on the structure shall be complete in
24 months from the issuance of the Land Use Permit. The time limit may be
extended up to six months by the Zoning Administrator for good cause. A second
extension shall be decided by the Planning Commission.

Planning Commission Direction: The Planning Commission can extend
Land Use Permit No. 05-03 with a fee of $500 or deny the extension of Land Use
Permit No. 05-03. If the extension is denied Staff will issue Land Use Permit No.
15-85 for the construction of the new building with a fee of $5,000.

Staff Recommendation: We recommend that the extension be approved.
