Pequot Lakes Staff Report 3 (a) - 1 <br />July 16, 2015 <br /> <br /> <br />PUBLIC HEARING – PRESERVE GOLF COURSE <br /> <br />Application: Conditional Use Permit – Conditions Review <br /> <br />Applicant: Preserve Golf Course <br /> <br />Agenda Item: 3 (a) <br /> <br />Background Information: This Public Hearing was tabled at the June, 2015 <br />Planning Commission Meeting. The Preserve Golf Course Environmental <br />Advisory Committee had requested review of the original conditions placed upon <br />the golf course in 1994 and the addition of two conditions. <br /> <br />At the June 18, 2015 Planning Commission Meeting, Dan Helbling requested the <br />addition of a condition to provide an easement for access to a landlocked parcel he <br />owns. Staff was directed to notify the Preserve LLC of this request. Management <br />and legal counsel for the Preserve LLC will be present at the July Planning <br />Commission Meeting. <br /> <br />Because the conditions were created 21 years ago, many of them have been <br />fulfilled, while others are on-going. At its meeting on May 8, 2015, the Preserve <br />Golf Course Environmental Advisory Committee reviewed the existing Conditions <br />and suggested the following revisions; Chairman Tom Beaver will be in attendance <br />to explain the revisions: <br /> <br />“Crow Wing County Planning Commission <br />April 13, 1994 <br /> <br />The following conditions imposed by the Planning Commission must be met by the <br />applicant: <br /> <br />1. The Environmental Plan for the Preserve shall be on file in the Planning & Zoning <br />office and shall become part of the formal findings of fact relating to this <br />application. <br />2. The applicant shall provide a copy of the executed lease/easement agreement <br />providing permanent access to the site from County Road 107. <br />3. 2. The applicant shall provide a scaled drawing of the location, dimensions and text <br />for any business sign. Setbacks shall be 10 feet from County Road right-of-way and <br />size shall be no more than 16 square feet. The sign shall be maintained in good <br />condition. <br />4. 3. The applicant shall obtain all necessary permits from the Army Corps of <br />Engineers, Minnesota Department of Natural Resources, Department of Health, <br />Pollution Control Agency, Soil and Water Conservation District, Department of <br />Agriculture. Copies of each permit or letter stating that no permit is needed shall <br />be kept on file within the Planning and Zoning Office. <br />Deleted: ¶ <br />¶ <br />¶ <br />¶
