<br />MINUTES 4 <br />Pequot Lakes Planning Commission <br />January 15, 2015 <br /> <br /> <br />When asked, Mr. Marohn explained the accessory structures do not need to be moved as <br />they exist today; they remain nonconforming. You can lessen a nonconformity, which <br />this does. <br /> <br />A motion was made by Planning Commission Member Habein, seconded by <br />Planning Commission Member Wilson, to approve the metes and bounds <br />subdivision, based on the following Findings of Fact: <br /> <br />1. The subject properties are properly zoned “Rural Residential”. <br />2. The lot widths of the proposed parcels meet the minimum standard of 200 feet. <br />3. The proposed parcels meet the minimum area requirements of the Rural <br />Residential zone. <br />4. The “Adams Tract” currently contains a non-conforming dwelling and a non- <br />conforming accessory structure. The subdivision does not increase the level of <br />non-conformity. <br />5. The “Hendrickson Tract” currently contains a non-conforming dwelling and a non- <br />conforming accessory structure. The subdivision does not increase the level of <br />non-conformity. <br />6. The subject properties are not adjacent to the municipal water and wastewater <br />utilities. All three parcels contain a private sewer system and a private water well. <br />7. The properties are suitable in their natural state for the intended purpose and these <br />lot splits would not be harmful to the health, safety, or welfare of future residents <br />or of the community. <br />8. The applicants are not proposing any provisions for water-based recreation. <br />9. The proposed lot layout meets the requirements of the ordinance. <br />10. The proposed side lot lines are at right angles to the existing road line and the <br />property line of the adjacent property. <br />11. Each of the proposed parcels has at least 33-feet of frontage on public right-of-way. <br />12. The subject property meets the requirements of the code for stromwater <br />management. <br />13. There are no public streets proposed within the development. <br />14. The proposed subdivision would bring the existing dwellings on the “Adams Tract” <br />and the “Hendrickson Track” into conformity so they are not encroaching on the <br />side yard setback. <br /> <br />All members voted “aye”. Motion carried. <br /> <br />b. Preserve Golf Course Wetland Fill <br />Zoning Administrator Bittner explained the SWCD is the Local Government Unit for the <br />City; the City is invited as a courtesy. Initially, the Preserve requested 15,000 to 20,000 <br />square feet of fill on Hole #5. They have now proposed to fill 10,000 square feet to allow <br />for easier play for women and junior golfers. <br />
