LICENSE AND MAINTENANCE AGREEMENT <br />THIS AGREEMENT, is made C��� /� , 2012, by and between the City of <br />Pequot Lakes, Minnesota (the "City") and Jessie Jane's Signs and Graphics, LLC, a <br />Minnesota limited liability company ("Developer"). <br />RECITALS <br />A. Developer desires to install pedestrian directory signage within the City of Pequot <br />Lakes at locations as identified on the attached Exhibit A(the "Directory Signs"). <br />B. The Directory Signs will be placed either within City Street right-of-way or upon <br />private property. <br />C. The City is willing to permit the installation of Directory Signs within the right- <br />of-way or on private property subject to the terms and conditions contained in this <br />Agreement. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the mutual obligations contained herein, the <br />City and Developer agree as follows: <br />� 1. Access for Construction and Maintenance. The City grants to Developer a license for <br />the purpose of installing and maintaining Directory Signs within the City's right-of-way <br />at the following locations: <br />a. <br />b. <br />c. <br />d. <br />for the installation and maintenance of Directory Signs in accordance with this <br />Agreement and in the locations as identified on the attached Exhibit A. <br />In the event that the placement of a Directory Sign, as identified on Exhibit A, is on <br />private property the Developer agrees that it must obtain permission from the property <br />owner in the form of an easement agreement for placement of the Directory Sign. <br />2. Desi�n. Installation, and Ownership. The Directory Signs shall be constructed in <br />accordance with plans and specification approved by the City Engineer and the City's <br />Planning and Zoning Administrator and as shown on Exhibit B. The plans and <br />specifications shall be prepared by the Developer at Developer's sole cost and expense. <br />The Directory Signs shall be placed no closer than One (1) foot from all property lines. <br />The installation of the Directory Signs shall be undertaken at Developer's sole cost and <br />`� expense.
