The State has a contract with the City identified as MnDOT Contract No. 1000645("Original Contract")to <br /> provide payment by the City to the State for the City's share of the costs of the removal and installation of the <br /> signal system construction and other associated construction upon,along and adjacent to Trunk Highway <br /> No. 371 from City of Nisswa to the City of Jenkins under State Project No. 1810-92(T.H.371=019);and <br /> 2. This Agreement is amended to include additional aesthetic pedestrian lighting unit installation costs and <br /> pedestrian lighting maintenance for Bridge No. 18009;and <br /> 3. The State and the City are willing to amend the Original Contract as stated below. <br /> Contract Amendment <br /> In this Amendment deleted contract terms will be struck-eut and the added contract terms will be underlined. <br /> REVISION 1. Article 3 is amended as follows: <br /> 3. Maintenance by the City <br /> 3.5 Pedestrian Lighting on Bridge No. 18009.Maintenance and ownership of Bridge No. 18009 pedestrian <br /> lighting construction. Maintenance ofpedestrian electrical lighting systems includes everything within <br /> the system,from the point of attachment to the power source or utility,to the last light on the feed point, <br /> including but not limited to re-lamping of lighting units or replacing of LED luminaires,repair or <br /> replacement of all damaged luminaire glassware,loose connections,luminaires when damaged or when <br /> ballasts fail,photoelectric control on luminaires,defective starter boards or drivers,damaged fuse <br /> holders,blown fuses,knocked down poles including wiring within the poles, damaged poles,pullboxes, <br /> underground wire,damaged foundations,equipment pad, installation of approved splices or replacement <br /> of wires,repair or extending of conduit, lighting cabinet maintenance including photoelectric cell, <br /> electrical distribution system,and painting of poles and other equipment. <br /> 3,5 3_6 Additional Drainage. Neither party to this Agreement will drain any additional drainage volume into the <br /> storm sewer facilities constructed under the design-build contract that was not included in the drainage <br /> for which the storm sewer facilities were designed,without first obtaining written permission to do so <br /> from the other party.
