-.� <br />ARTTCLE I <br />DEFIl�TITIONS <br />Section 1.1. Defmitions. All capitalized terms used and not otherwise defined herein <br />shall have the following meanings unless a different meaning clearly appears from the <br />context: <br />Asreement means this Agreement, as the same may be from time to time modified, <br />amended or supplemented; <br />Business Dav means any day except a Saturday, Sunday or a legal holiday or a day <br />on which banking institutions in the City are authorized by law or executive order to close; <br />C� means the City of Pequot Lakes, Minnesota; <br />Countv means Crow Wing County, Minnesota; <br />Developer means Brett and Sarah Dale, LLC, its successors and assigns; <br />'� <br />Develonment District means the real properiy described in the Development Program; <br />Develonment Proeram means the development program approved in conneciion with <br />the Development District; <br />Develoument Pronertv means the real property described in Exhibit B attached to this <br />Agreement; <br />Event of Default means any of the events described in Section 4.1 hereof; <br />Note Pavment Date means August 1, 2002, and each February 1 and August 1 of each <br />year thereafter to and including February l, 2017; provided, that if any such Noie Payment <br />Date should not be a Business Day, the Note Payment Date sha11 be the ne�rt succeeding <br />Business Day; <br />Pro�ect means the construction of an approximately 5,100 square foot retail store to <br />be located on the Development Property; <br />Site Imnrovements means the demolition and other site improvements to be <br />undertaken on the Developrnent Property and identified on Exhibit D attached hereto; � <br />�oa�oao.� 2 <br />
