2.2. The CONTRACTOR will be responsible for maintaining records, ordering <br /> chemicals, and performing all operation and maintenance for the <br /> FACILITIES. The CONTRACTOR will periodically inspect and supervise <br /> the operation of the CITY'S public water and wastewater supply system <br /> and perform such duties necessary to comply with State & Federal law, <br /> rules and regulations applicable to the FACILITIES, including completing <br /> and submitting all required reports to the State and Federal governments. <br /> Said duties shall specifically include: <br /> 2.2.1. Visit FACILITIES daily and charge City for the daily visits based <br /> on the Monthly rate specified in this Agreement; <br /> 2.2.2. Prepare and submit on behalf of CITY all required MPCA and MDH <br /> monthly operations reports as required by both regulatory agencies or <br /> as otherwise required by any other governmental agency, state or <br /> federal,having jurisdiction under applicable law,rules or regulations; <br /> 2.2.3. Perform chlorine, fluoride, and phosphate testing on a weekly basis or <br /> as otherwise required by the MDH or as required pursuant to applicable <br /> law, rules or regulations; <br /> 2.2.4. Collect and submit fluoride and bacteriological samples to MDH on <br /> a quarterly basis or as required pursuant to applicable law, rules or <br /> regulations; <br /> 2.2.5. Collect and submit groundwater monitoring well samples three (3) <br /> times a year as required by MPCA,or as required pursuant to applicable <br /> law,rules or regulations; <br /> 2.2.6. Prepare and submit monthly regulatory reports or as required pursuant <br /> to applicable law,rules or regulations; <br /> 2.2.7. Perform annual fire hydrant flushing, lubrication, flag <br /> installation/removal or as required pursuant to applicable law, rules <br /> or regulations; <br /> 2.2.8. Prepare annual Consumer Confidence Report, and distribute and <br /> submit Consumer Confidence Report as required by MDH or as <br /> required pursuant to applicable law, rules or regulations; <br /> 2.2.9. Turn on/off curb stops valves as requested; <br /> 2.2.10. Respond to water/sewer complaints, notify CITY of water/sewer <br /> complaints, and arrange for repairs to address the water/sewer <br /> complaints by a qualified vendor of CITY's choice, at CITY's direct <br /> expense and as authorized by CITY in CITY's direction.;. <br /> 2 <br />
