City Council Minutes <br />March 5, 2013 <br />Page 4 of 9 <br />1. NOTE TO BE PAID MONTHLY, IN 57 INSTALLMENTS AT 5% <br />INTEREST <br />2. DELINQUENT PAYMENTS WILL RECEIVE A $25 LATE FEE. <br />3. THE NOTE MUST BE PAID IN FULL PRIOR TO THE END OF <br />THE TIF DISTRICT <br />4. THE LOAN PAYMENTS MUST BE TIED TO THE TIF DISTRICT; <br />(IF LOAN IS IN DEFAULT, CITY USES THE TIF FUNDS TO <br />MAKE LOAN PAYMENTS) <br />5. THE DEVELOPER IS RESPONSIBLE FOR PAYMENT OF ALL <br />FEES ASSOCIATED WITH THE LOAN RESTRUCTURE. <br />COUNCIL MEMBER GARDNER SECONDED THE MOTION. MOTION <br />CARRIED 3 -1. COUNCIL MEMBER PEDERSON OPPOSED. <br />6. Planninq Commission Report <br />Report received by Council. <br />6.1. Wellhead Protection Update <br />Mayor Adams noted that Dawn Bittner is in the process of working on an <br />update of the City's Wellhead Protection Plan. <br />6.2. Planninq Commission Report <br />The Council acknowledged the Planning Commission report. <br />6.2. Preliminary and Final Plat for SuperValu <br />COUNCIL MEMBER AKERSON MOVED TO REMOVE THE <br />SUPERVALU PRELIMINARY PLAT AND FINAL PLAT APPLICATIONS <br />FROM THE TABLE. COUNCIL MEMBER GARDNER SECONDED THE <br />MOTION. MOTION CARRIED 4 -0. <br />Justin Burslie informed the Council that the Planning Commission has <br />reviewed the preliminary and final plat requests by SuperValu. He stated <br />that the Planning Commission granted an after - the -fact variance to <br />SuperValu which resolved the impervious coverage issue. Justin noted <br />that the Planning Commission is recommending approval of the <br />preliminary and final plats. <br />
