(1) Payment Required Prior to Connection: Before connecting <br />to the City's water system, a City water availability charge <br />as hereinafter provided shall be paid. <br />(2) Additional Land Use Permit: If, after the initial availability <br />charge is paid, an additional land use permit is issued, the <br />use of the property changes, or new water connection is <br />made, the availability charge shall be recalculated and any <br />additional charges shall be paid. <br />(3) Change by Ordinance: Any change in the City water <br />availability charge amount, as hereinafter set forth shall be <br />by Ordinance Amendment. <br />B. Determination of Charge. The amount of the availability charge <br />shall be determined by the City by first determining the number of <br />Equivalent Residential Connections (ERC's) applicable to the <br />particular property. The number of ERC's shall be calculated in <br />accordance with the Sewer Availability Charge (SAC) Procedural <br />Manual (using the most current edition) from the Environmental <br />Services Division of the Metropolitan Council (located in St. Paul). <br />The number of ERC's shall equal the number of SAC units from <br />this document. All residential units are 1 ERC or 1 WAC, except <br />for apartments with a minimum of 4 units. For apartments with a <br />minimum of 4 units, with no plumbing for individual laundry <br />facilities in any of the units, each unit is counted as 0.8 ERC, or 0.8 <br />WAC. For various non - residential types of establishments, this <br />document includes an Appendix A: SAC Criteria for Commercial <br />Properties. Once the appropriate number of ERC's are determined <br />in this manner, the availability charge shall be calculated using the <br />most recent ordinance establishing the availability charge. <br />C. Determination of ERC's. The City shall determine the number of <br />ERC's. <br />D. Transfer of ERC's. Once established, the number of ERC's shall <br />remain the same on the property. An ERC can be transferred on the <br />property from a structure being removed to a structure being <br />constructed. <br />E. Uses Not in the Reference Document. Any use not represented in <br />the above SAC Reference Document shall be subject to <br />determination of the appropriate number of ERC's by the City <br />based on estimated flows. <br />
