2  <br />  <br />AGREEMENT <br /> BETWEEN <br />CITY OF PEQUOT LAKES <br />AND <br />LAW ENFORCEMENT LABOR SERVICES LOCAL 490, POLICE DEPARTMENT UNIT <br /> <br />PREAMBLE <br />The City of Pequot Lakes, hereinafter referred to as the "Employer," and Law Enforcement Labor <br />Services Local 518. Law Enforcement Labor Services, hereinafter referred to as the "Union” representing <br />employees in those classifications covered by this Agreement, do hereby enter into this Agreement for the <br />purpose of setting forth the full and complete understanding of the parties regarding terms and conditions <br />of employment of the bargaining unit members. This Agreement incorporates the entire understanding of <br />the parties and shall supersede and replace all previous agreements between the parties hereto. <br /> <br />ARTICLE 1 <br />RECOGNITION <br />1.1 Pursuant to Bureau of Mediation Services certification, BMS Case No. 22PCE1948, Law <br />Enforcement Labor Services, shall be recognized as the sole and exclusive representative for a <br />bargaining unit of employees defined as follows: <br />All licensed peace officers in the position of Sergeant employed by the City of Pequot Lakes <br />Police Department, Pequot Lakes, who are public employees within the meaning of Minn. Stat. <br />179A.03, subd. 14, excluding all other employees. <br /> <br />ARTICLE 2 <br />EMPLOYER SECURITY <br />2.1 No employee in the bargaining unit, will engage in, encourage, sanction, or support any strike, or <br />the withholding in whole or in part of the full performance of their duties during the life of this <br />Agreement, except as specifically allowed by the Public Employment Labor Relations Act of <br />1971, as amended. <br />2.2 The failure or refusal on the part of any employee to comply with the provisions of this Article 2 <br />may result in immediate discipline up to and including discharge, which shall be subject to the <br />grievance procedure. <br /> <br /> <br />
