Planning Commission Minutes <br />January 22, 2024 <br />Page 2 of 5 <br />----------------------------- <br />4.1 Variance Anolication: <br />Justin Burslie, City Planner, called the applicant Jane Byrne and placed her on <br />speaker phone so she could be a part of the meeting and be available in the <br />event any questions arose. At the November meeting it was stated Jane could <br />attend virtually if that worked better for her. <br />Justin reexplained the situation and findings and facts regarding 4.1 Variance <br />Application #23-80 - to replace and expand a pre-existing structure located with <br />the OHW level setback and construct an SSTS drainfield with the road right-of- <br />way setback. Property location: 27701 Janco Lane. This is a continuation of <br />conversations held at the November 2023 PZ Meeting: <br />Burslie stated this variance application/request had originally needed additional <br />information: One was to provide an updated survey with proposed drainfield <br />dimensions and location in relation to where the property lines and Janco Lane <br />are and the second was to update the survey with floodplain information. In the <br />packet today — the applicant provided the information requested. The proposed <br />drainfield is on the west side of the property (last meeting there was talk on if this <br />property was on plotted City ROW or a private driveway based on certificate of <br />survey from the 1900s — whether its public or private, it's still 10 feet from Janco <br />Lane — so it meets the required setbacks to the ROW). The other part of this is <br />since the last meeting, the DNR has now told us that based on some additional <br />information that the house is in fact not in the floodplain area — there was a study <br />done that our area hydro was not aware of at the time of the last staff report. So <br />basically the variance request now does not include the septic system and it <br />does not include anything regarding the floodplain. So it is now a request to <br />expand the pre-existing structure, increase the height just a little bit, and expand <br />50% of the structure towards the west and north. <br />The staff report provided has information from November, and then items from <br />today with many strikethroughs for you to see the changes and updates made <br />over time from the DNR and us. We've revised the findings to remove all <br />references to the SSTS and floodplain and revise the proposed condition of <br />approval. Removing the previous two conditions and adding a new one stating <br />that the `as built certificate of elevation survey showing locations of the lowest <br />level of the proposed dwelling being at or above RFPE (regulatory flood plain <br />elevation) elevation of 1,222 DGVD29 must be submitted to the City of Pequot <br />Lakes prior to permit expiration or upon completion of the dwelling construction, <br />whichever is sooner. (This means once the dwelling is built, submit a survey <br />showing that the dwelling meets the regulatory flood plain elevation which is 1- <br />foot above the BFE.) <br />This no longer requires a variance for the septic nor anything for flood plain. <br />Chair L.Larson mentioned that part of the concern back in November was about <br />the existing holding tanks. She wondered if we should add that as part of the <br />conditions that those are removed — or is it not necessary? Justin asked the <br />homeowner if she's having the holding tanks removed and replacing them with <br />
