City Council Minutes <br /> January 6, 2015 <br /> Page 6 of 11 <br /> spray irrigation property that will be associated with the Highway 371 <br /> project. <br /> MnDOT will need approximately 16.72 acres of the spray irrigation land for <br /> the Highway 371 right-of-way. The property was appraised at $50,000. <br /> MnDOT is requesting the City to honor the Memorandum of Agreement <br /> and to donate the $50,000 parcel of property. <br /> The City Clerk explained that the resolution must be approved by a two- <br /> thirds vote of the Council which is a state law requirement if the Council <br /> decides to transfer the property and dispensing with the Planning <br /> Commission's review of the property conveyance. <br /> ,rf, <br /> Council Member Sjoblad stated that the Memorandum of agreement is <br /> non-binding. He noted that at the time,of the signing many things have <br /> changed including an additional ten/Sars of wear on the W' 7'' <br /> equipment. He suggested that the City ccintintieto negotiate with MnDOT <br /> regarding a solution for the wastewater treatment. <br /> It was the consensus of the Council to take no action at this time on the <br /> right-of-way conveyance to MnDT <br /> 9.4. Freeze Run Policy <br /> Mike Loven explained the need for a freeze run policy. He stated that it is <br /> necessary to keep City water mains and services lines open when there is <br /> a chance of freeing. <br /> COUNCIL MEMBER LOUKOTA MOVED TO APPROVE THE FREEZE <br /> RUN/FROZEN WATER SERVICE LINES POLICY. COUNCIL MEMBER <br /> AKERSON SECONDED THE MOTION. MOTION CARRIED 5-0. <br /> 9.5. North Washington Project Time Extension <br /> Tim Houle explained that the contractor exceeded the time frames that <br /> were in the construction contract for the North Washington Avenue <br /> project. He stated that he and Mayor Sjoblad met with the contractor to <br /> discuss the issue. Tim Houle reviewed the options available to the <br /> Council. <br /> The Council discussed the options. Council Member Pederson stated that <br /> the contractor did a good job on the project, there were no complaints and <br /> he worked well with the City. Mayor Sjoblad stated that he attended all of <br /> the construction meetings and watched the project on a daily basis. He <br />
