AGENDA ITEM #9.5 <br /> Lakes <br /> REPORT TO <br /> CITY COUNCIL <br /> Report Prepared by: Sandy Peine, City Clerk <br /> Date: January 6, 2015 <br /> Subject: North Washington Project Time Extension <br /> Report: As directed at the December 2014 City Council meeting, <br /> Council Member Dave Sjoblad, Public Works Supervisor Mike Loven, and <br /> City Engineer Tim Houle scheduled a meeting with Al DeChantal, the <br /> Contractor on the North Washington Avenue project, to discuss project time, <br /> liquidated damages, and related impacts to the overall project budget. <br /> Tim explained to Al that the Council did not approve the time extension <br /> request Change Order and asked about liquidated damages. Tim went on to <br /> point out the Contract Time requirements, when Al was able to get traffic <br /> onto North Washington, the $1,000 per calendar day liquidated damages <br /> clause, and other related items. <br /> Al understood the Contract Times and the liquidated damages clause —the <br /> Contract is the Contract. Dave and Tim acknowledged that the project, while <br /> taking longer, did get constructed and, overall, looks good. <br /> We started out talking about the time from September 26 to October 15, <br /> which was when traffic was allowed onto the street. This is 19 calendar <br /> days. Al asked about working days (generally, not including Holidays and <br /> weekends when they were not on-site), which Tim and Dave were willing to <br /> discuss /negotiate. <br /> Al then pointed out that assessing liquidated damages is a serious matter.
