higher and is 1564 sq. ft., physical distance ofnew garage 125, no closer than 125' from <br /> '�- OHW, <br /> Those are conditions 7 and 8. <br /> Second: Mark <br /> A motion was made by Scott Pederson, seconded by Mark Hallan,to approve the <br /> Variance request,based on the following Findings of Fact: <br /> For a Variance to Enlarge a Non-Conforming Structure <br /> 1. Adhering to the Ordinance and not allowing an addition to the existing dwelling <br /> would not create an undue hardship. There is an existing structure that has been <br /> used on the property for decades. If this is not sufficient for the owners of the <br /> property, there is ample room to build a conforming structure. <br /> 2. There are no characteristics of the property that make strict adherence to the <br /> Ordinance impractical. While the lot is narrow, it is large and has ample room for <br /> construction. <br /> 3. A deviation, with conditions limited the construction to the conditions found in <br /> Section 17-4.4, Subpart 4 (one-time addition) would be in keeping with the spirit <br /> and intent of the Ordinance. <br /> 4. The proposed residential use is permitted in the Shoreline Residential zone. <br /> 5. The variance will not alter the character of the neighborhood. Adjacent properties <br /> have homes that have OHW encroachments similar to the dwelling on this <br /> property. <br /> 6. Reasonable use of the property has existing on the property for decades. The <br /> Ordinance provides for reasonable use of this property. <br /> On the construction on a non-conforming lot: <br /> 7. Strictly applying the minimum lot width requirement would prohibit any <br /> construction on the property and thereby create an undue hardship. <br /> 8. The lot size, which was not created by the land owner, creates a situation where <br /> strict adherence to the Ordinance would be impractical. <br /> 9. A deviation to provide for construction on a non-conforming lot would be in <br /> keeping with the spirit and intent of the ordinance, which would be to provide for <br /> residential construction on the property. <br /> 10. The proposed residential use is permitted in the Shoreline Residential zone. <br /> 11. The variance will not alter the character of the neighborhood. Adjacent properties <br /> have homes that have OHW encroachments similar to the dwelling on this <br /> property. <br /> 12. Without a variance for lot width,reasonable use of the property would not exist. <br /> After discussion,the following conditions were added: <br /> 1.
