higher and is 1564 sq. ft., physical distance ofnew garage 125, no closer than 125' from
'- OHW,
Those are conditions 7 and 8.
Second: Mark
A motion was made by Scott Pederson, seconded by Mark Hallan,to approve the
Variance request, based on the following Findings of Fact:
For a Variance to Enlarge a Non-Conforming Structure
1. Adhering to the Ordinance and not allowing an addition to the existing dwelling
would not create an undue hardship. There is an existing structure that has been
used on the property for decades. If this is not sufficient for the owners of the
property, there is ample room to build a conforming structure.
2. There are no characteristics of the property that make strict adherence to the
Ordinance impractical. While the lot is narrow, it is large and has ample room for
construction.
3. A deviation, with conditions limited the construction to the conditions found in
Section 17-4.4, Subpart 4 (one-time addition) would be in keeping with the spirit
and intent of the Ordinance.
4. The proposed residential use is permitted in the Shoreline Residential zone.
5. The variance will not alter the character of the neighborhood. Adjacent properties
have homes that have OHW encroachments similar to the dwelling on this
property.
6. Reasonable use of the property has existing on the property for decades. The
Ordinance provides for reasonable use of this property.
On the construction on a non-conforming lot:
7. Strictly applying the minimum lot width requirement would prohibit any
construction on the property and thereby create an undue hardship.
8. The lot size, which was not created by the land owner, creates a situation where
strict adherence to the Ordinance would be impractical.
9. A deviation to provide for construction on a non-conforming lot would be in
keeping with the spirit and intent of the ordinance, which would be to provide for
residential construction on the property.
10. The proposed residential use is permitted in the Shoreline Residential zone.
11. The variance will not alter the character of the neighborhood. Adjacent properties
have homes that have OHW encroachments similar to the dwelling on this
property.
12. Without a variance for lot width, reasonable use of the property would not exist.
After discussion, the following conditions were added:
1. The size of the addition shall not exceed fifty percent of the size of the
structure it is being added to.
MINUTES 4
Pequot Lakes Planning Commission
November 20, 2008
