Pequot Lakes Fire District Bylaws 09/2022 <br /> drugs or alcohol while on duty. <br /> 11.PLFD members shall be held responsible for all PLFD property under their <br /> charge. <br /> 12.Members shall be expected to arrive on time and prepared to participate in PLFD <br /> meetings and trainings. Tardiness disrupts the efficiency of the PLFD and will not be <br /> tolerated. <br /> Every member of the PLFD is expected to be aware of, and act in compliance with, this code of <br /> conduct, its related policies, and any policies put in place by the city of Pequot Lakes. Violation of <br /> these principles and policies is a serious matter and will be dealt with by the officers of the PLFD. <br /> Any member, who violates these policies or any of the policies set forth in the bylaws of the PLFD <br /> shall be subject to appropriate disciplinary action (up to and including dismissal from the PLFD) in <br /> accordance with the disciplinary section of these bylaws. <br /> Section 2 <br /> It shall be the duty of the officers (under the direction of and in cooperation with the fire chief) of the <br /> PLFD to investigate all claims made against a member. Every member shall be entitled to a hearing <br /> for any complaint involving possible suspension or expulsion from the PLFD. These hearings shall <br /> consist of a minimum of five (5) officers (the fire chief must be one of the five) of the PLFD, and the <br /> accused. <br /> Section 3 <br /> A member of the PLFD may be disciplined, suspended or expelled from the PLFD by the officers in <br /> accordance with the procedures hereinafter provided. <br /> 1. When appropriate, disciplinary actions shall be progressive in nature and consistent <br /> with the seriousness of the infraction. Progressive discipline will normally start as an <br /> oral counseling session with the officer in charge of a PLFD function or work <br /> detail making a written record using the oral counseling form recommended by the PLFD. <br /> This form shall be placed in the members personnel file for a period of one (1) year. <br /> 2. A written reprimand is appropriate for a second violation of the same or similar nature, or as <br /> first action for a more serious (as determined by the officers) violation. Written reprimands are <br /> considered very strong disciplinary actions. the letter will contain: <br /> a. Statement of charges in sufficient detail to enable the member to fully understand <br /> the violation, infraction, conduct or offense for which he/she is to be disciplined. <br /> b. Statement that it is an official letter of reprimand and that it will be placed in the <br /> members permanent personnel folder. <br /> c. Previous offenses in those cases where the letter is considered a continuation of <br /> progressive discipline. <br /> d. Any corrective action deemed necessary by officers including but not limited to <br /> apologies (written or oral), peer counseling, or additional training to prevent further <br /> violations. <br /> 3. The third course of discipline shall be suspension of a member for a period not to exceed sixty <br /> (60) days. Suspensions will generally be used as the third course of action in the progressive <br /> discipline guideline but may be used as a first or second action taken depending on the <br /> severity of the violation (as determined by the officers of the PLFD). A suspension report must <br /> contain: <br /> a. The name of the member being suspended. <br /> b. Length of the suspension <br /> c. Specific description of the incident <br /> d. Reason for recommendation for suspension <br /> e. Previous disciplinary actions taken <br /> f. Signature of officers and the fire chief <br /> g. Reasons for bypassing progressive discipline (if applicable) D <br />
