RESOLUTION NO.23-15 <br /> A RESOLUTION VACATING [A PORTION OF] LILAC STREET. <br /> WHEREAS,the City Council previously passed Resolution No. 23-15 noting its interest in <br /> vacating pursuant to Minnesota Statute § 412.851 a portion of Lilac Street legally described as: <br /> That part South Brunes Street,(also known as Lilac Lane) as dedicated in BRUNES <br /> ROYCE ADDITION, according to the recorded plat thereof Crow Wing County, <br /> Minnesota, lying southerly of the following described line: Beginning at the southeast <br /> corner of Lot 4, Block 5, said plat; thence North 82 degrees 09 minutes 11 seconds East, <br /> assumed bearing along the easterly extension of the south line of said Lot 4 for distance <br /> of 66.00 feet to the east line of South Brunes Street and said described line there <br /> terminating. <br /> and setting a public hearing to consider the vacation of such street; and <br /> WHEREAS,a public hearing to consider the vacation of such street was held on the 5th day of <br /> July,2023,before the City Council in the City Hall located at 4368 Main Street at 6:00 p.m. after <br /> due published and posted notice had been given, as well as personal mailed notice to all affected <br /> property owners by the City Clerk on the 5th day of June, 2023 and all interested and affected <br /> persons were given an opportunity to voice their concerns and be heard; and <br /> WHEREAS, any person, corporation or public body owning or controlling easements contained <br /> upon the property vacated,reserves the right to continue maintaining the same or to enter upon <br /> such way or portion thereof vacated to maintain,repair,replace or otherwise attend thereto; and <br /> WHEREAS,the Council in its discretion has determined that the vacation will benefit the public <br /> interest because <br /> The previous zoning change of parcels abutting the cul de sac to be vacated has deemed <br /> the portion of the street to be vacated as unneeded for public use. <br /> And WHEREAS, four-fifths of all members of the City Council concur in this resolution; <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> PEQUOT LAKES MINNESOTA AS FOLLOWS: <br /> That such petition for vacation is hereby granted and the(portion of) street described as follows <br /> is hereby vacated: <br /> That part South Brunes Street,(also known as Lilac Lane) as dedicated in BRUNES <br /> ROYCE ADDITION, according to the recorded plat thereof Crow Wing County, <br /> Minnesota, lying southerly of the following described line: Beginning at the southeast <br /> League of Minnesota Cities Model Resolution: 9/30/2019 <br /> Vacating a Street on Council Initiative Page 1 <br />
