Under the Open Meeting Law, cities must close a meeting for preliminary <br /> consideration of allegations or charges against an individual subject to its <br /> authority. If the council concludes that discipline of a nature may be <br /> warranted,further meetings or hearings must be open. (Minnesota Stat. <br /> 471,705,Subd Ib,c and d) <br /> City Council Action <br /> If after the hearing, or in the event no hearing is granted, the City Council <br /> finds that the charges are sustained; the dismissal, suspension or demotion <br /> shall be final. <br /> If the City Council finds that the charges are not sustained, the employee, if <br /> he/she has been suspended pending investigation, shall be reinstated and <br /> paid all back pay due for the period of suspension. If there has been no <br /> suspension, the employee shall be continued in the position as though the <br /> disciplinary action had not been taken. In the event of a hearing, findings by <br /> the City Council shall be in writing and filed with the City Clerk within five <br /> (5) business days after completion of the hearing. The City Council shall <br /> give written notice of the decision to the employee, upon written demand. If <br /> the disciplinary action involves the removal of a Military Veteran entitled to <br /> a hearing under Minnesota Statutes Section 197, et.seq., the hearing shall be <br /> held in accordance with Minnesota Statutes Section 197.46. <br /> 11. SAFETY <br /> The personal safety of each employee of the City of Pequot Lakes and the <br /> prevention of occupationally induced injuries and illnesses is of primary <br /> importance. To the greatest degree possible, management seeks to maintain <br /> a safe and hazard-free work environment. <br /> It is the policy of the City Council to provide city employees with safe <br /> working conditions. New employees should receive a copy of the City's <br /> Health and Safety Program Manual. Employees are required to read the <br /> manual carefully and discuss areas of concern with their supervisor. <br /> Employees are required to develop safe work habits and to contribute to the <br /> safety of themselves and co-workers. <br /> 30 <br />
