I spoke with Corky this morning. I told him the City gave him until June 30 to be completely done. I told him that he still has some non-vegetated areas and his bituminous patch needs to be re-done. Thus, I will report to the City Council Tuesday night he is not finally completed. The City Council then needs to decide whether to keep working with him or to pursue default remedies. Corky said that we have to give some time for the grass to grow - it is the middle of summer. I told him that the bituminous patch needs clean, straight saw cut lines. He said they jackhammered neat edges for their patch. He is upset because we /the City is nitpicking everything. I told him I am all ears if he could show me where I am trying to enforce something NOT in the construction contract or NOT in the Developer Agreement. He mentioned several other things; some I had a comment on, some I did not. Not that we need a detailed answer to everything, and not that we have to argue with him, but we should at least have a response in our back pocket. He told me that the City owes him for SAC and WAC charges. I did not have a response for him because I did not know background on this. Per the Developer Agreement or elsewhere, does the City owe him money? He told me he had to pay for mistakes the City Attorney made. I did not have a response for him because I did not know background on this. Paul or anybody else, do you know what he is talking about here? He talked about the City blowing out some pavement, washing out his grass seed, or something when they had to flush last year and their patch wasn't any better than his pavement patch. I told him that the reason the City had to flush was due to his chlorination operations. He does not agree that they were the cause. I did not have a response for him on the pavement blow out/ patch or washed out seeding because I did not know background on this. Gary or Tina, I probably got his complaints wrong because he was spitting nails as he was talking, but do you know anything about this and what the City did or did not do? 6/27/2008
