Houle@wsn-mn.com <br /> Sent: Friday, June 27, 2008 10:28 AM <br /> To: Sandy Peine; Mike Loven; Willis Hoyt; Bryan Drown; Paul Sandelin <br /> Cc: Mike Rude; Don Anderson <br /> Subject: Pequot Lakes - Trailside Estates <br /> I spoke yesterday with Will Hoyt on the above Subject project. <br /> If anyone believes any of the following is not correct or has any comments, please hit "Reply <br /> All" so we are all on the same page. <br /> Sandy Peine had forwarded me two June 26, 2008 letters from Will; one was to Mr. Smith and <br /> one was to the City. <br /> The letter to the City indicated Landecker, who was hired by the City to observe construction in <br /> the field , was certifying that the public improvements have been completed in substantial <br /> conformance with the plans and specifications. <br /> The letter to Mr. Smith indicated Landecker was providing a written notice that the recent <br /> bituminous patch next to the lift station was unacceptable and needed to be re-done as <br /> warranty work. <br /> When I spoke to Will about the above two letters, I pointed out that the City Council had given <br /> Whe p p Y g <br /> Mr. Smith until the end of June for final completion. In my opinion, still having warranty work to <br /> do was NOT final completion. <br /> I told Will that this is what I would be reporting to the City Council at their July 1 regular <br /> meeting . I asked Will if he believed Mr. Smith would be surprised about such a statement, <br /> considering he received a copy of his letter to the City saying they were in substantial <br /> conformance. <br /> Will said they (I believe Bryan Drown from their office too) had conversations, or traded voice <br /> mails, with Mr. Smith about the bituminous patch and some other items needing to be taken <br /> care of. I brought up the lack of vegetation across from the lift station (my understanding is that <br /> while maybe a percent vegetation coverage is not specifically called out in the construction <br /> contract itself, the construction contract and State Statute does require a General Storm Water <br /> Permit and that Permit requires 70%, I believe, vegetation coverage - Mr. Smith does not have <br /> this kind of coverage established , especially across from the lift station; also, I know of no <br /> Notice of Termination finalized yet). <br /> Will did not believe Mr. Smith should be surprised if I stated everything was not finalized. <br /> Thus, unless there are dramatic changes between now and next Tuesday, this will be my <br /> report to the City Council on Tuesday, July 1 , 2008: <br /> ++++++++++++++++++++++++++ <br /> 7/1/2008 <br />
